By creating an account or using any part of UpPapa (including the website, shop, game, and UpPapa Club), you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and agree to these Terms. If you are using UpPapa on behalf of a minor, you confirm you are their parent or legal guardian.

• You are responsible for maintaining the security of your account and the email address associated with it
• You must provide accurate and truthful information when creating your profile
• You are responsible for all activity that occurs under your account
• You must not share your account credentials or let others access your account
• If you suspect unauthorized access, contact us immediately at privacy@uppapa.com

Your content is yours. You retain full ownership of all content you create on UpPapa, including journal entries, photos, quotes, letters, and any other personal data.

• We do not claim ownership of your content
• We will never use your photos, journal entries, or personal data for marketing without your explicit written consent
• You grant us a limited license to store, display, and process your content solely to provide the UpPapa Club service to you
• This license ends when you delete your content or your account
• You can export your data at any time

You agree not to:

• Use UpPapa for any illegal or unauthorized purpose
• Upload content that infringes on the intellectual property rights of others
• Upload harmful, abusive, threatening, or obscene content
• Attempt to access other users' accounts or data
• Interfere with the security or proper functioning of the platform
• Use automated tools (bots, scrapers) to access or extract data from UpPapa
• Manipulate game scores, leaderboards, or points through unauthorized means

All products sold through our shop are subject to availability. We reserve the right to discontinue or modify products at any time. We make every effort to display product details accurately, but we cannot guarantee that descriptions, colors, sizing, or other content will be error-free due to screen differences and manufacturing variations. Prices are subject to change without notice. We reserve the right to correct pricing errors even after an order has been submitted.

We reserve the right to refuse or cancel any order at our discretion, including but not limited to orders that appear fraudulent. All payments are processed securely through Shopify. We do not store your payment information on our servers.

Shipping, delivery times, and related matters are governed by our Shipping Policy. Delivery dates are estimates only and are not guaranteed. We are not responsible for delays caused by carriers or events outside our control.

Returns, refunds, and exchanges are governed by our Return & Refund Policy. By placing an order, you agree to the terms outlined in that policy.

• The UpPapa Club is a free service — no credit card required, no hidden fees
• We reserve the right to modify, suspend, or discontinue features of the Club at any time
• We will make reasonable efforts to notify you of significant changes
• While we strive for reliability, we do not guarantee 100% uptime or that data will never be lost — please keep backups of important content
• Game scores, points, and leaderboard rankings are for entertainment purposes and have no monetary value

All content on this site — including text, images, graphics, logos, and designs — is the property of UpPapa or its licensors and is protected by applicable intellectual property laws. The UpPapa name, logo, and brand elements are trademarks of UP PAPA, LLC. You may not use, reproduce, or distribute any of our content without written permission.

We may use third-party tools or services to operate our platform (see our Privacy Policy for the full list). We are not responsible for the content, accuracy, or practices of third-party websites or services. Your use of third-party services is subject to their own terms and policies.

• You can delete your account at any time — all your data will be permanently removed within 30 days
• We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the platform
• If we terminate your account, we will notify you by email with the reason
• Upon termination, your right to use the service ceases immediately

To the fullest extent permitted by law, UpPapa and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our site, services, or products. Our total liability for any claim shall not exceed the amount you paid for the specific product or service giving rise to the claim, or $100, whichever is greater. The UpPapa Club is provided "as is" without warranties of any kind.

You agree to indemnify and hold harmless UP PAPA, LLC, its affiliates, and partners from any claim, demand, or damage (including reasonable legal fees) arising out of your breach of these Terms, violation of any law, or infringement of any third-party rights.

We reserve the right to update or modify these Terms at any time. When we make significant changes, we will notify registered users by email and update the "Last updated" date at the top of this page. Continued use of the site after changes constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Los Angeles County, California.
